Terms of Service
By commissioning or buying from Sammy Smiles you accept all terms listed below. Please read them carefully.
Allergy warning: All of our suits and materials come in contact with both dogs and cats on a daily basis. If you are slightly allergic we can wash your suit before shipping to minimize the amount of dandruff that might be on your suit but if you have a sever allergy we do not recommend you purchasing from us as we can not guarantee your product hasn't come in contact with any animals.
Quote's and Pricing: For general pricing please see our 'Prices' tab. This will give you a base price on how much you should start to save. To submit a quote please see our 'Quote tab'. If the form is live you're free to send a quote and we will email you back within a week. If the form is not up that means we are currently closed for quotes and will reopen when our commission opening gets closer. By receiving a quote you are not guaranteed a slot nor do you have to apply to get a slot next opening. Quote's are typically good for 6 months to a year. If prices have increased then a tweet will go out saying older quotes are no longer accepted and will need to be resent.
Age Restriction: Sammy Smiles does not work with minors even if the minor has parental permission. That meaning, anyone under the age of 18 will not be quoted or given a slot. If we find out the person is underage your commission will be terminated and refunded. If work has started on the suit then it will be auctioned off. If we find out the person is underage after the suit has been delivered your warrenty with us will be broken and you will be black listed from commissioning us again. State issued ID may be required at any point. If this can not be provided or we feel it is fake then we will also cancel the commission.
Payment: Payment is through Paypal or Cashier's check only. If items are bought at con, they may be purchased with cash. This is the only exception.
Payment Plans: We would like to avoid long payment plans due to our quick turn around times. Thus payment up front if preferred. A short payment plan can be discussed but anything over two months is currently not accepted. Full payment must be received before work is started, if something comes up and you can not pay your slot can be held for a month maximum. Anything over that you forfeit your slot and will be refunded everything but the nonrefundable down payment.
Payment Plan Interest: If a payment plan is set up you will be given specific percentages that are due on set dates. If you agree to this plan then you are held responsible on paying by those dates. There will be a 2 days grace period. If you are late on any payment there will be an interest charge of 2% added to your total amount every day you are late. If you are over 2 weeks late on payment your project will go in the red and you will have exactly 2 weeks to completely pay off the remaining balance (including the interest charges). If one month has gone by with no payment received Sammy Smiles will assume you are cancelling your slot. In this case, no refund will be given. If work has started then the design will be altered and resold.
An example of how payment plans will look;
You pay 30% nonrefundable deposit. 30% will be due on the 15th of the following month. The last 40% will be due by the 15th of the following month.
If your total for the commission is $1000 then you owe $300 on acceptance, $300 on the 15th of the following month, and $400 the last month. If you are late on your second payment, starting on the 18th you will begin to gain interest of 5% each day. So each day a total of $20 will be added to your total commission amount that you owe ($1000 for this example). After two weeks of no payment your commission will go in the red, at this point you have gained $280 in interest. You will then have exactly two weeks to pay off your commission (In this example that would be $980.) While you project is in the red it will not gain any more interest. If you're late on a payment but pay BEFORE your project goes into the red, you will need to pay both your agreed upon percentage and the interest. Interest is not split between the two remaining payments.
Refunds: If we choose to cancel the commission you will receive a 100% refund. If work has been started on the suit when we cancel then the design will be altered and it will be put up for sale. If the commissioner is the one to cancel, their refund will depend on the amount of work that is done on the suit. Please note 30% of the suit is nonrefundable and will not be refunded unless we the maker cancel the commission.
0% work done - 70% Refund
25% work done - 50% Refund
50% work done - 30% refund
50%-100% work done- 10% refund
Deadlines: At this time we do not accept hard deadlines but if you have an event you would like your suit by please let us know and we will take that into consideration. We however can not promise your suit to be delivered by this time.
Concept Art: For bodies, heads, and fullsuits we require at least a clear front and back reference of your character. For everything else a clear front or side reference may be accepted but we reserve the right to ask for you to draw or commission a clearer reference.
Fur colors: Please be advised that fur is rather limiting in the range of colors available. We will try to get as close as possible but some colors simply can not be found in stores.
Changes to the design: Minor changes can be made before work is started. Once work is started changes can not be made. Major Design changes will have to be discussed and may increase the total due.
WIPS: Once work has started you will receive daily wips on what we have accomplished that day. You are free to share these wips with whomever you would like even if we don't post them publicly. Once you approve the DTD pattern, markings and colors can not be changed. This is the last chance to change anything you see wrong. WIPS are sent ether through Telegram or Twitter DM's please make sure you have one or the other before commissioning us.
Duck tape Dummies: DTD's are required for a number of different products. These need to be shipped and in our hands at least two weeks before your due start date. You will have receive a warning two weeks prior if we have not received your DTD. If your start due date hits and we have not received your DTD your commission may ether be moved back a month or it will be considered as you cancelling the commission.
In the near future we hope to make a DTD tutorial. Until then here is a good one to follow.
Repairs: Repairs are free for six months after the suit has been shipped with commissioner paying shipping to and from. After 6 months there will be a fee for repairs. If the customer has purposefully changed something, such as shorting the arms themselves and then wants them to be made longer, this will be considered as a refurbish and charge as according. If another maker works on the suit outside of small repairs, such as holes, then you will be charged for repairs even if it is within the first six months. The suit must be washed and dried before being shipped to us. If the suit is delivered unwashed then it will be sent back without any repairs being done.
Kigu Designs: As with fursuits, you will be sent the pattern of your kigu for approval. Once this design is approved no alterations can be made. If the customer does not alert us of a design fault during this stage it can not be fixed once the design is approved and work has been started. If the kigu is finished or is in the sewing process and a design fault is noticed, but was approved during the pattern stage, it will not be fixed. Make sure you look over the pattern carefully and if there are any questions regarding placement or marking shapes bring it up during the patterning stage. We can not stress enough that once it has left the pattern stage and has been approved that the design can not be changed.
